Terms of Service

1. Acceptance

By creating an account or using TRACEBUILD (the "Service"), you agree to these Terms of Service and to the Privacy Policy. If you do not agree, do not use the Service.

2. The Service and early access

TRACEBUILD provides PDF markup, measurement, construction takeoff, and estimating tools. During early access, TRACEBUILD Lite is provided free of charge and may change or be interrupted at any time.

3. Your pricing data and the license you grant

[The load-bearing data rights section. Counsel to finalize the exact wording. It must grant TRACEBUILD, at minimum, the following, consistent with the Cost Dataset Strategy section 4.2:]

• A broad, perpetual, royalty free, worldwide license for TRACEBUILD to store, reproduce, aggregate, anonymize, create derivative statistical works from, and commercially use the material and labor pricing data you enter into the Service.
• Permission to use that data to build, improve, and operate a construction cost estimation dataset and any products derived from it, including after your own account or subscription ends.
• Confirmation that TRACEBUILD owns the aggregated and anonymized dataset and any derived indices, while you retain ownership of your own raw project data.
• A privacy commitment that individual, identifiable pricing is never exposed to other users. Only aggregate figures, computed across many independent contributors, are surfaced.

4. Your representations about data you input

• You represent and warrant that you have the right to input the pricing data you provide, and that it is your own historical, supplier, or negotiated pricing.
• You will not upload, paste, or import any third party's copyrighted or licensed cost database, including an export or extract from a licensed cost data product (for example a subscription cost database). Doing so may breach that provider's license and these Terms.
• TRACEBUILD may screen bulk imports and decline, quarantine, or remove data that appears to originate from a licensed third party database.

5. Acceptable use

6. Estimating disclaimer

Built in unit costs are illustrative budgetary figures, not a published cost database and not professional or financial advice. Verify pricing and productivity against current local conditions before bidding. You are responsible for your own estimates and bids.

7. Disclaimers and limitation of liability

[Counsel to finalize: Service provided "as is", warranty disclaimers, and a liability cap.]

8. Changes to these Terms

We may update these Terms. Material changes will be reflected in the version date above, and continued use after an update constitutes acceptance.
